These terms apply to your use of the Crunch Banners Shopify app (“the App”). The App is provided by JHW Contracting Limited, 20 Wenlock Road, London, N1 7GU, United Kingdom (“we”, “us”). By installing or using the App, you (“you”, the merchant) agree to these terms. Shopify’s own terms also apply to your use of Shopify and the Shopify App Store.

1. What the App does

The App lets you design the cookie banner and preferences panel shown on your Shopify storefront. Your visitors’ consent choices are recorded and applied by Shopify’s Customer Privacy API. Shopify’s privacy settings decide where a banner is required. The App changes how the banner looks and what it says. It doesn’t decide where consent is required, and it doesn’t store consent itself.

2. Your responsibilities

  • Your own compliance is your responsibility. You decide which laws apply to your store and whether your banner, its text, your privacy settings and your use of tracking tools meet them. The App is a design tool. It is not legal advice, and using it doesn’t make your store compliant with any law. Get advice from a qualified professional if you need it.
  • Your content. You’re responsible for the text, links and other content you add to your banner, and for having the right to use it.
  • Setup. You need to switch on the App’s app embed in your theme and choose your Shopify privacy settings as the App’s setup steps describe. If you leave Shopify’s own banner switched on, visitors may see two banners.
  • Fair use. Don’t use the App to break the law, to mislead visitors, to interfere with the App or its infrastructure, or to try to get around plan limits.

3. Plans, trials and billing

  • The App has a Free plan and a Pro plan. The current prices, the free trial and what each plan includes are shown on our Shopify App Store listing and in the App.
  • Shopify bills Pro charges for us, on your Shopify invoice, in your billing currency, under Shopify’s billing terms. If you cancel during the free trial, you aren’t charged.
  • You can change plans or cancel at any time in the App or by uninstalling it. When you cancel, Pro features stop working at the end of your current billing period, or straight away if Shopify’s billing ends them sooner. Your banner keeps working on Free templates. We keep your Pro settings, so upgrading again restores them.
  • Refunds. We don’t refund partial billing periods, except where the law requires it. Refunds are issued through Shopify.
  • We may change prices. If we do, we’ll tell you at least 30 days in advance. A new price applies only after you approve it through Shopify.

4. Design with AI

  • Design with AI (Pro) suggests changes to your banner design. Its suggestions can be wrong or unsuitable, so review every suggestion in the preview. Nothing is published until you save.
  • Design with AI has a fair-use limit (currently 200 requests a month), shown in the App. We may adjust the limit to manage costs or prevent abuse.

5. Privacy

Our Privacy Policy explains how we handle information about you and your store’s visitors.

6. Availability and changes to the App

We work to keep the App available and working, but we don’t promise it will be uninterrupted or error-free. If the App isn’t available, Shopify’s own consent handling and your store keep working, but your custom banner may not show.

We may improve, change or remove features. If we remove a paid feature you rely on, we’ll give you reasonable notice. We may stop offering the App. If we do, we’ll give you at least 30 days’ notice, and no further charges will be made.

7. Intellectual property

We own the App, including its templates, code and design. While you use the App, you may use it on your Shopify stores. You keep all rights to your own content. You give us permission to store, process and display it only as needed to provide the App.

8. Suspension and termination

You can stop using the App at any time by uninstalling it. We may suspend or end your access if you seriously or repeatedly break these terms, or if we have to in order to comply with the law or Shopify’s requirements. Where reasonable, we’ll tell you first. Our Privacy Policy explains what happens to your data after you uninstall.

9. Disclaimers

Except as these terms state, the App is provided “as is” and “as available”. To the extent the law allows, we make no other promises about the App. That includes any promise that it will meet a particular legal or regulatory requirement, or that it will be fit for a particular purpose.

10. Limitation of liability

  • Nothing in these terms limits liability that can’t legally be limited, such as liability for death or personal injury caused by negligence, or for fraud.
  • Otherwise, we aren’t liable for:
    • loss of profit, revenue, sales, data or goodwill;
    • indirect or consequential loss;
    • fines, penalties or claims that arise from how you configure your store, your banner or your tracking tools.
  • Otherwise, our total liability to you for all claims in any 12-month period is limited to the greater of: (a) the amount you paid us for the App in those 12 months; or (b) £50.

11. Changes to these terms

We may update these terms. If a change is significant, we’ll tell you in the App or by e-mail at least 14 days before it takes effect. If you keep using the App after that, you accept the new terms. If you don’t agree with them, uninstall the App.

12. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you’re a consumer living elsewhere, you keep any protections that the law where you live gives you.
